Twenty-six RAPV members traveled to Boston on June 10 to participate in the 30th annual “Realtor® Day on Beacon Hill” conducted by the Massachusetts Association of Realtors® (MAR).  

We were among 400+ Realtors® who stormed the state house to discuss key issues that impact consumers and the economy. The keynote address was provided by Northampton legislator and Senate President Stanley Rosenberg.  

I was thrilled so many members where there for the first time.  It was great to have such an enthusiastic group with many pledging to return.  Here is what two first-time attendees had to say:

"It was a great trip.  I will be attending again in 2016," said J. Kim Crow of Keller Williams Realty in Feeding Hills.

"It was a very interesting trip and I found it to be very enjoyable with the group we had.  Mark me down for next year."
said Peter Davies of RE MAX Hill & Valley in Northampton.  

Their participation, and that of all our RAPV attendees, is recognized in this news release, complete with photos. I applaud their continued support and dedication to the Association’s government affairs activities which benefits Massachusetts homeownership and helps support private property rights.

Awards Banquet celebrates members and students

One-hundred eighty members were at the Annual Awards Banquet on June 11 at the Log Cabin to celebrate the announcement of Sue Drumm as the 2015 Realtor® of the Year and Lisa Kraus as the 2015 Affiliate of the Year.  Congratulations ladies!  It was a celebratory night.  Ten of the fourteen college scholarship recipients were present.  They were honored with certificates and a power point presentation.  Over $10,800 was awarded to the students.

Legal Scales.pngQ: I am I’m working on taking a listing that was built before 1978. The seller did a lead test from a testing kit that she bought and it was positive for lead paint. A version of  EPA's pamphlet "Protect Your Family from Lead in Your Home" states that studies suggest that home test kits for lead are not always accurate, and that consumers should not rely on home test kits to assure safety. Therefore, does the use of home test kits for lead constitute knowledge of lead-based paint for disclosure purposes? Must this be disclosed to potential buyers?

Q: The landlord that I represent has stated that he will not accept a tenant application from a tenant who has a credit score below 450. I have received an application from a tenant who is a recipient of Section 8 subsidy who has a credit score of 400. Must the landlord accept this applicant, since he is a recipient of a public subsidy? 

Q:  I have heard from a prospective tenant that there is a requirement under Massachusetts law that a landlord provide an executed copy of a lease within 30 days in order to form a valid tenancy. Is this true? If a tenant does not receive a copy, what effect would it have on the tenancy?
